These terms are conditions of every license granted below.
1. Definitions
"Software" means the OpenSquawk software and accompanying materials made
available with these terms, including any portion, copy, modification, or
derivative work.
"Licensor" means each copyright holder who makes a contribution to the
Software available under these terms.
"You" means the individual natural person accepting these terms. An
organization may not be "You" and receives no rights under these terms unless
the applicable Licensor gives it separate written permission.
"Personal Use" means use solely by You, for Your own private recreation,
personal study, experimentation, or hobby, without use by or for the benefit
of any other person or organization and without any anticipated commercial,
professional, organizational, or public application.
"Organization" includes any company, partnership, sole proprietorship,
employer, client, nonprofit, charity, association, club, community group,
educational institution, public body, and government entity, whether or not
it charges money or operates for profit.
"Distribute" means to provide a copy of the Software or a modification of it
to another person, including through a public repository or fork. Merely
allowing another person to interact with functionality of a running instance
is not Distribution and remains prohibited by Section 4.
2. Personal use license
Subject to these terms, each Licensor grants You a non-exclusive,
non-transferable, non-sublicensable, worldwide, royalty-free copyright
license to download, make copies of, modify, and run the Software solely for
Personal Use.
You may self-host the Software only on systems controlled by You and only
for access and use by You. You may not give any other person access to the
Software or its functionality.
3. Distribution license
Subject to these terms, each Licensor grants You an additional
non-exclusive, worldwide, royalty-free copyright license to Distribute
unmodified or modified copies of the Software, including through public
repositories and public forks, provided that You:
- do so entirely free of charge and receive no payment or other commercial
benefit from the Distribution;
- include the complete corresponding source code;
- include these terms and all copyright, attribution, and license notices;
- license the entire copy or modification under these same terms and impose
no additional or conflicting terms; and
- clearly identify material modifications and state that they are not an
official OpenSquawk release.
Every recipient must independently comply with these terms. Distribution
does not grant permission to run or host the Software for anyone other than
the individual recipient themself.
4. No provision of functionality to others
You may not make a running instance of the Software or any of its
functionality available to any other person or Organization, directly or
indirectly, whether for payment or free of charge. This prohibition includes,
without limitation:
- software as a service (SaaS), hosted, managed, cloud, or application
service offerings;
- public, shared, organizational, club, association, community, classroom,
demonstration, or multi-user instances;
- access over the internet, a private network, or a local network by anyone
other than You; and
- operating or administering an instance on behalf of anyone else.
This restriction applies even if access is limited, private, invitation-only,
nonprofit, charitable, educational, at cost, or entirely free of charge.
5. No organizational or commercial use
Except for non-commercial Distribution expressly permitted by Section 3,
You may not use the Software:
- for or on behalf of an Organization;
- in connection with employment, self-employment, a trade, business,
profession, product, or service;
- to generate revenue or other commercial advantage;
- for internal business or organizational purposes;
- in a commercial product or service; or
- to provide paid or unpaid hosting, support, training, consulting, or any
other service to another person or Organization.
6. Contributions
If You intentionally submit code, documentation, or other material to the
Licensor for inclusion in the Software (a "Contribution"), You retain
ownership of Your Contribution but grant every current and future copyright
holder of the Software a perpetual, irrevocable, worldwide, non-exclusive,
transferable, sublicensable, royalty-free license to use, reproduce, modify,
prepare derivative works from, distribute, publicly perform, publicly
display, sublicense, and relicense Your Contribution under any terms,
including as part of a commercial license or offering.
You also grant a perpetual, irrevocable, worldwide, royalty-free patent
license under patent claims You can license that are necessarily infringed
by Your Contribution alone or in combination with the Software. You represent
that You are legally entitled to make these grants. If You do not agree to
these contribution terms, do not submit a Contribution.
7. No trademark license
These terms do not grant permission to use the OpenSquawk name, logos, or
other trademarks except as necessary to truthfully identify the Software,
preserve existing notices, and identify a fork or modification as unofficial.
8. Exceptions and separate permissions
No rights are granted except those expressly stated in these terms. However,
the applicable Licensor may grant You a written exception or a separate
written license for any use otherwise prohibited by these terms, including
commercial, organizational, hosted, SaaS, third-party access, or distribution
use. An exception or separate license applies only to the persons, Software,
uses, duration, and conditions expressly stated in it. A request for
permission, or the Licensor's failure to respond or enforce a restriction,
does not grant permission.
Any rights You may have under applicable law independently of this license,
such as statutory exceptions to copyright, are not restricted by these
terms.
9. Termination
Your rights under these terms terminate automatically and immediately if You
violate any of them. Upon termination, You must stop using and Distributing
the Software and delete all copies in Your possession or control, except
where applicable law requires otherwise.
10. Disclaimer of warranty and limitation of liability
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TO THE MAXIMUM
EXTENT PERMITTED BY LAW, THE LICENSORS AND CONTRIBUTORS SHALL NOT BE LIABLE
FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY ARISING FROM, OUT OF, OR IN
CONNECTION WITH THE SOFTWARE, THESE TERMS, OR THE USE OF THE SOFTWARE.
11. Third-party material
These terms apply only to material for which they are included. Third-party
components remain subject to their respective licenses.
This is a source-available license. It is not an open-source license as
defined by the Open Source Initiative and not a free-software license as
defined by the Free Software Foundation.
